Filing for Child Support

If you and your child's parent have separated and you need to start your child support, you may file for child support with your local family court.  Child Support may be required by filing a child support request with the Family Court and by scheduling a motion hearing. During our initial consultation, we can discuss the child support process so you will have a better idea about what to expect.

South Carolina has adopted the South Carolina Child Support Guidelines which outline the rules about what is considered when a Family Court Judge is determining a child support amount. In the vast majority of child support cases, the SC Child Support Guidelines will apply. It is only in exceptional circumstances that the Family Court can deviate from the SC Child Support Guidelines.

You’ve been served in a Child Support Case

If you have been served in a child support case, you need to have legal representation to make sure you are not ordered to pay more child support than what is appropriate given the circumstances of your case. In most caes the South Carolina Child Support Guidelines govern the amount of child support that wil be ordered. In theory, this is a calculation where there you simply input income numbers for the parents and out pops the child support amount. In reality, what incomes are used, what expenses are reasonable, and other factors make it important that you have legal representation to walk you through the process.
